How to register a trade mark in the UK

Register a trade mark: Identify your class

When applying for a trade mark, it is essential to specify the type(s) of goods and/or services the trade mark will cover. This specificity is crucial because the trade mark protection extends only to the listed categories. Careful consideration of the intended use of your trade mark is, therefore, paramount. There are 45 classes in total: 34 for various goods and 11 for services.

What happens after you apply?

Upon submission, your trade mark application will be reviewed by the Intellectual Property Office (IPO). You will receive feedback along with an examination report. If no issues are identified, the IPO will publish your application in the Trade Marks Journal for a period of two months. During this time, the public can view and potentially object to your intended trade mark. If no objections are raised, the IPO will register your trade mark for a duration of ten years.

Benefits of a trade mark

Registering a trademark provides robust protection for your brand and is a valuable asset for your business. It grants you the exclusive right to use the trademark for your specified goods and/or services. Moreover, it provides legal recourse to sue for unauthorised use. A trade mark also helps safeguard your business’s reputation. Additionally, you have the option to sell your trade mark or license it to others for a fee. Find out more about trade marks here.

Trade marks outside the UK

A trade mark is a territorial right. Registering a trade mark in the UK protects your brand within the UK and the Isle of Man only. To secure trade mark protection in Europe or other countries, you will need to follow the respective application processes for those regions.
